A €17,500 ‘Nappy Ending’ for toddler who could not be potty trained after crash

A 5 year old boy has been awarded €17,500 after he could not start playschool because he was not potty-trained.

The boy was just 3 when he was involved in a “high impact” car accident in Co Donegal in May, 2014.

The boy was a back-seat passenger in a car seat when the crash happened at a crossroads.

As a result of the accident, the boy suffered bruising to his groin and thigh areas.

Barrister Fiona Crawford told Letterkenny Circuit Court that as a result of these injuries, the little boy could not undergo potty training.

And when his parents applied to have the boy enrolled in playschool, the boy was turned down because he was not potty-trained.

Ms Crawford told the court that the boy had further issues with potty training at the time.

She said the insurance company had made an offer of €14,000 to the boy but that she was not recommending that this be accepted.

Judge John O’Hagan said he had a little reluctance in not recommending the offer and asked Ms Crawford to return to the insurance company.

Ms Crawford return with an increased offer of €17,500 which was recommended by Judge O’Hagan.
