Court finds that man did not have ‘knife’ in his possession

A man charged with the possession of a knife and other articles has had his case dismissed after a court found the weapon was a piece of pipe.

Ciaran Cleary, of 12 Fairgreen Hill, Letterkenny, appeared at Letterkenny District Court charged with the alleged offence.

The court was told the 19-year-old was found with the ‘weapon’ at Lower Main Street, Letterkenny on July 3rd, 2016.

However, solicitor Frank Dorrian argued that in order for the ‘weapon’ to be deemed a knife it would have to be a knife, a blade or sharply pointed which they pipe was not.

A handed of the item was handed to Judge Paul Kelly.

He agreed and asked Garda Inspector Sean Grant what his opinion was.

Inspector Grant said he would have to agree with Mr Dorrian and the case was dismissed.
