Case struck out as Storm Emma meant man couldn’t pay fine

A Buncrana man, who was unable to pay a fixed charge penalty notice last week as his local Post Office was closed due to Storm Emma, had the charge struck out.

Seamus Doherty (49), of Beauville Lane, Aghilly, Buncrana, appeared at Buncrana District Court, charged with using a vehicle without an NCT on April 7, 2017 at Main Street, Buncrana.

Mr Doherty went to pay the fine last week, but found that the Post Office was closed. On Monday of this week, Mr Doherty again went to pay the fine, but was told that he was too late and the payment couldn’t be processed.

“The weather was bad last week, he didn’t have the chance to pay when he made the attempt so I’m striking the matter out,” said Judge Gerard Jones.
