Judge warns man to get help to pass driving theory test

A man has been told to try and get help to pass his driver theory test after he was caught on the road with no licence or car insurance.

Brian Toland, 22, from Drim, Malin Head, was charged with driving without a licence and no insurance at Church Road, Carn, on March 1, last year.

He appeared before Carndonagh District Court, where he admitted these charges and also a separate charge for failing to produce his documents.

The court heard that Garda Fiona McFadden stopped Mr Toland, a father of two children, at Church Road, but he had no insurance or licence.

Defence solicitor Ciaran MacLochlainn said Toland had failed his driver theory test four times and was very embarrassed that he had not passed it yet.

He said his young client, a fisherman by trade, had difficulties with education. He added that Mr Toland had no previous convictions and pleaded guilty at the first opportunity.

Mr MacLochlainn said the Malin Head man was very anxious to get a licence and didn’t want a driving ban, adding that the car he had been stopped in cost him €500 and was seized by gardaí and destroyed.

Judge Paul Kelly said there were a number of organisations out there that were designed to help people with educational difficulties pass the theory test.

“There are people who are in this situation but there are organisations out there to help – he can’t be on the road without a licence,” said Judge Paul Kelly.

Mr MacLochlainn said he believed these agencies weren’t well known to the general public.

Judge Kelly said he would not give him a disqualification as it was his first offence. However, he fined him €250 for no insurance and took the driving without a licence charge into consideration.

The remaining charges for failing to produce his documents were struck out.
