Girl awarded €20,000 after trauma of seeing her parents in accident

A teenage girl who witnessed her parents in a car accident has been awarded €20,600.

The girl was 13 at the time of the accident which happened in November, 2015 on the main Moville to Derry Road in Inishowen.

The settlement was made to the girl at Letterkenny Circuit Court.

Barrister Peter Nolan referred to the accident as a ‘secondary victim situation.’

He said the girl was traveling in a car behind her mother and father when their car was involved in an accident.

The court heard that the girl witnessed the accident and had suffered shock and developed nervous anxiety.

A consultant psychiatrist, Dr Mary Maguire, treated the girl and said the girl was suffering was acute distress disorder as a result of the accident.

The girl was a good student but had felt disappointed by the results of her Christmas exams and felt this was because of the accident.

Mr Nolan said the girl’s family has asked for €1,000 of the €20,000 to be allocated in advance for a family holiday which he felt was an excellent idea.

Judge John O’Hagan said he was happy to recommend the offer and that he was glad to see the family had recovered from their ordeal.
