Student who sexually assaulted sleeping woman ordered to pay her €1,000

A college student who sexually assaulted his on/off girlfriend while she slept has been ordered to pay the young woman €1,000 in compensation.

The young man, who cannot be named by order of Judge Paul Kelly at Letterkenny District Court, appeared in court alongside his parents.

A probation report on the incident, which happened in 2017, had previously been presented to an earlier sitting of the court.

Judge Kelly said the facts had been previously outlined and they told how both people had been drinking.

However, he said that while the accused had consumed a lot of alcohol, this did not excuse what had happened.

He said the young man now accepted that the young woman did not show any receptive signs when he touched her.

In fact, she had told him to stop and he did and he said he was sorry to the young woman.

The report added that the young man comes from a good family and that he does show remorse for what he did.

Judge Kelly said he had also read the victim impact statement in the case and that the young woman was still suffering as a result of her ordeal.

She had panic attacks and suffered from depression and did not want to go anywhere alone.

The Judge ordered the young man to pay €1,000 compensation to his victim and this was paid later that day following the recent court sitting.

Judge Kelly then ordered the accused man to keep the peace for two years on his own bond of €250.
