June 16, 2020

A DONEGAL man was told by a judge to take his kung-fu attempts to a ‘more suitable location’.

Judge Paul Kelly was addressing the case of father-and-son Patrick and Eddie Harkin, who appeared before him charged in connection with an incident on December 21, 2019.

Gardaí attended the scene of a reported disturbance at The Diamond, Castlefin at 12.20am on the date in question.

Patrick Harkin (72), of Flat 1, The Diamond, Castlefin, who was highly intoxicated, became aggressive, telling Gardaí to ‘fuck off’ on a number of occasions before saying: “Do you know who I am? Let’s fight.”

Parickt Harkin was asked to desist when approach but, the court heard, he attempted to strike Garda Corcoran and was arrested.

As Gardaí were dealing with Pat Harkin, Eddie Harkin (28), of Flat 1, The Diamond, Castlefin, ran onto the street.

Sergeant Jim Collins told the court: “He was swinging his arms and legs in a kung fu-type fashion and he directed abusive language to the Gardaí, calling them ‘scumbags’ and ‘bastards’ before being arrested.”

Solicitor for the two accused, Mr Patsy Gallagher, said: “It’s fair to say that neither of these man are the Van Damme of Castlefin.

“Mr Harkin senior has been in a serious health condition and is on a copious amount of prescribed medication.

“This was the result of a number of days’ drinking, which ended that night.

“These men have been alcoholics for a number of years.”

Judge Paul Kelly said: “You should tell Mr Harkin to practice his marital arts in a more appropriate location in the future.”

Eddie Harkin also appeared in connection with threatening, abusive or insulting behaviour at Ard Mhuileann, Convoy and Townsparks, Convoy on January 16, 2018.

“He was knocking on the doors seeking a party,” Sergeant Collins said. “Toys were tossed about the place and he was told to leave, but he went to another house. He apologised to both parties and was the worse for wear.”

Judge Kelly imposed a fine of €200 and gave four months to pay.
