Teen accused of kicking man’s head six times during assault

December 12, 2020

A TEENAGER has appeared in court after an unprovoked assault saw him attack two men.

The teen, who cannot be named for legal reasons, appeared before Letterkenny District Court this week.

The court heard that the youth, who is now 17, was 15 when the alleged incident took place on July 14, 2019.

Sergeant Jim Collins told the court that the youth punched a man with a closed fist at the Orchard Inn, Letterkenny.

The court was told that, after walking off down High Road, the youth returned and continued his attack.

The court heard that the teenager kicked the man in the head six times while he was on the ground.

Another man, who attempted to intervene, was also allegedly attacked in the process.

The incident was captured on CCTV.

One of the victims received injuries that were consistent with being struck with an object such as a glass. The other man suffered a laceration to an ear and two broken teeth.

Medical reports and accompanying images were submitted to the court.

Sergeant Collins said he believed that the matters were very serious and were appropriate for the Circuit Court.

Defence solicitor , Mr Rory O’Brien, said that the accused is due to turn 18 in eight months’ time. One he turns 18, he would face more severe penalties.

“The State will need to move very quickly to facilitate him being death with in a timely manner,” Mr O’Brien said. “It would be very tight.”

The possibility of a delay was raised as concerning by Mr O’Brien.

Judge Alan Mitchell ordered that CCTV and full disclosure of interviews and documentation be handed to the defence before December 14.

The case was adjourned to December 21.
