Man got drunk and fought with Gardai at ‘going away’ party

A man who got so drunk on his going away party to Australia that he didn’t remember fighting with Gardai.

Eamon McBrearty pleaded guilty to a charge under the Public Order Act when his case was heard at Letterkenny District Court.

The court was told the 24-year-old could not be in court as he was now living in Australia.

Garda Sgt Jim Collins said that Gardai were called to the scene of a number of males outside an ambulance at 2.45am on January 5th, 2020 at Ramelton Road in Letterkenny.

McBrearty, of Trentaboy, Drumkeen, was there and he was highly-intoxicated.

He made a jump at Gardai and also tried to fight with other men before he fell over.

He was arrested and taken to Letterkenny Garda station where he gave no trouble and later apologised.

The court was also told that the accused had no previous convictions.

His solicitor, Patsy Gallagher said his client’s friends had thrown a ‘going away’ party for him as he was heading back to Australia having been home for the Christmas of 2019/20.

He said McBrearty got very drunk but doesn’t normally drink and had no recollection of the events of the night.

He said he was back working as a landscaper in Australia and was about to apply for permanent residency there.

He said McBrearty was due to come home again last Christmas but was prevented from traveling due to the Covid regulations.

Judge Paul Kelly said that if McBrearty arranged for a donation of €350 to be made to the Letterkenny Youth and Community Group he would not record a conviction against the accused.
