Two men are set to stand trial over their involvement in a serious incident in Milford last year in which one of them produced a gardening spade.
Books of evidence were served on Paul Gormley and Eamon Lynch at Letterkenny courthouse on Monday.
At Letterkenny District Court, Garda Matthew Burke gave evidence of serving a book on each defendant at 12.27pm on Monday. The pair are charged in connection with an incident on February 5, 2022 at Radharc na Cille, Milford
Gormley, a 23-year-old with an address at Culglas, Kilmacrennan Road, Milford, is charged with burglary. Gormley is also charged with affray and faces a further charge of assault. Gormley has further been charged with using or engaging in threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace or being reckless as to whether a breach of the peace may be occasioned.
Lynch, a 56-year-old from Primrose Park, Sion Mills, County Tyrone is also charged with affray and with assault. Lunch also faces a charge of producing an article, a garden spade, during the course of a dispute.
Sergeant Jim Collins told the court that the Director of Public Prosecutions (DPP) has consented to the pair being sent forward to the next sitting of Letterkenny Circuit Court, which commences on October 17 next.
Judge Éiteáin Cunningham made an order returning each man for trial to the next Letterkenny Circuit Court sitting. Judge Cunningham administered the alibi warning and made a section 56 order relating to videotapes of interviews.
The court heard that all matters, including summary matters, have been added to the indictment.
Legal aid was granted to solicitor Mr Kieran O’Gorman – who represents each of the accused – and one legal counsel was assigned.
