A Donegal man accused of raping a woman will stand trial at the Central Criminal Court.
The 23-year-old man, who cannot be named for legal reasons, appeared before Letterkenny District Court.
He is charged with two counts of rape and also faces two charges of sexually assaulting the woman. The offences are alleged to have been committed at the man’s home on a date in 2021.
Detective Garda Elaine Boyle gave evidence of charging the man.
He was charged that he did rape the woman, a charge contrary to section 4 of the Criminal Law (Rape) (Amendment) Act, 1990.
He was further charged that he did rape the woman, contrary to section 48 of the Offences Against the Person Act 1861 and section 2 of the Criminal Law (Rape) Act 1981 as amended by section 21 of the Criminal Law (Rape) (Amendment) Act, 1990.
The man faces two charges of sexual assault, contrary to section 2 of the Criminal Law (Rape) (Amendment) Act, 1990 as amended by section 37 of the Sex Offenders Act, 2001.
After each charge, the accused man told the detective: “No comment”.
The man was before the court on foot of directions from the Director of Public Prosecutions (DPP), who has consented for the accused to be sent forward for trial at the Central Criminal Court.
Gardai consented to bail being granted, provided that certain conditions were handed down.
Judge Éiteáin Cunningham granted bail in the accused’s own bond of €200, nil cash. He is to surrender his passport and not apply for a new or duplicate travel document.
He is to have no contact with any alleged injured party or any witnesses in the case.
The man was represented by Frank Dorrian. Legal aid was granted in the matter.
The case was adjourned to July 7 for the service of a book of evidence.
