A young Castlefin man who told Gardai to f*** off and raised his arm in “a threatening manner” during a drunken St Patrick’s Day rant has been ordered to make a donation to charity.
Brandon Bogan appeared at Letterkenny District Court.
The 24-year-old was charged that on March 17th, 2024 he did resist one Sergeant Brendan McCann, a peace officer acting in the execution of his duty, knowing or being reckless that he was, a peace officer acting in the execution of his duty.
The accused pleaded guilty to the charge.
Garda Sergeant Jim Collins outlined the facts to the court.
He told how on March 17th, 2024 at 7.16pm on Navenney Street in Ballybofey, Brogan was observed by Gardai arguing with a female.
The argument between the pair continued down an alleyway and Gardai intervened.
Brogan, of Emmett Park, Castlefin, reacted by telling Gardai to ‘f*** off” and also raised his arm in a threatening manner.
Sergeant Collins said Brogan was arrested and continued to be uncooperative when brought to Letterkenny Garda Station.
The man’s solicitor, Mr Frank Dorrian told the court that his client had no previous convictions.
Judge Eiteain Cunningham told the accused that Gardai were on duty trying to do their best and that they should not have to deal with such abuse.
She told Brogan that if he had an issue there were other avenues but that she would not tolerate the abuse of Gardai.
“Levelling that type of abuse at Gardai will not be accepted by this court,” she said.
She told the accused that because he had no previous convictions, she would leave him without a criminal record if he made a donation of €200 to St Vincent de Paul.
The case was adjourned until May 12th to allow for the donation to be made.
