The family of a cyclist killed in a crash in Co Donegal have demanded to know why a prosecution was not considered against the driver of the vehicle involved.
Adrian Mullan was killed after being struck by a vehicle in Inishowen on October 17th, 2015.
The 42-year-old father of three from Derry died from his injuries following the incident on the main Redcastle to Gleneely Road.
Speaking at the pre-evidential hearing into the late Mr Mullan’s inquest, the family’s solicitor Patrick McDaid said the family wanted to know the reason why the Director of Public Prosecutions did not pursue the matter.
No evidence was offered of any alleged wrongdoing by the driver during the pre-evidential hearing.
Speaking at Buncrana Courthouse, Mr McDaid said that if any new evidence came to light there was “a duty” on the DPP to investigate this.
However, he said the family were agreeable to allow a date to be set for the inquest.
Coroner Dr Denis McCauley outlined the witnesses he wanted to attend the inquest and give evidence.
They include another cyclist who was along with Mr Mullan, another van driver who was near the scene and the driver of the car involved as well as the Garda and medical witnesses.
Solicitor for the woman driving the car involved in the crash, Mr Ciaran Mac Lochlainn said his client would come and give their evidence on the date set out for the inquest hearing.
Coroner McCauley set the hearing date for January 30th next.
