A man has been sent forward for trial for an alleged burglary at a Letterkenny car dealership.
A book of evidence was served on Thomas McDonagh this week.
The 45-year-old was brought to Letterkenny District Court having been arrested on foot of bench warrants.
McDonagh, of Canal Road, Letterkenny, is facing charges over an incident at Diver’s Garage, Canal Road, Letterkenny, on May 4, 2019.
The accused man is charged that he took possession of a mechanically propelled vehicle without the consent of the owner, contrary to section 112 of the Road Traffic Act, 1961.
He is charged with having entered a building, a garage at a car dealership, as a trespasser and committed an arrestable offence, to wit, the unauthorised taking of a vehicle. This charge is contrary to section 12 of the Criminal Justice (Theft and Fraud Offences) Act, 2001.
He is further charged with causing criminal damage to a motor vehicle belonging to Terence Diver.
McDonagh is also charged with causing criminal damage on a roller shutter door and a steel entrance gate.
Garda Feena McManamon gave evidence of executing three bench warrants on McDonagh at Letterkenny Garda Station on June 9, 2025 after meeting the accused by arrangement.
McDonagh was cautioned in the usual manner and brought before the court.
Sergeant Jim Collins told the court that the Director of Public Prosecutions (DPP) has consented for McDonagh to be sent forward for trial to the October sitting of Letterkenny Circuit Court.
Judge Eiteáin Cunningham made an order returning McDonagh for trial, administered the alibi warning and made a section 56 order, relating to videos of interviews.
Legal aid was granted to solicitor Ms Donna Ponsonby and one legal counsel was assigned in the case.
Bail was granted in McDonagh’s own bond on condition that he commit no offence and be of good behaviour. He is to reside at Neil T Blaney Road, Canal Road, Letterkenny and be available for contact by gardai 24-7 on a telephone number provided to the authorities.
