Man caught with child porn on laptop gets suspended sentence

A 47 year old man caught with child pornography on two computers at his home has escaped a jail sentence.

Dariuz Jastrezebski of Drumfries in Inishowen appeared at Letterkenny Circuit Court where he pleaded guilty to the charges.

Barrister Ciaran O’Rourke said the accused had cooperated fully with Gardai after he was caught in May 2010.

He added the accused, a Polish national, was deeply ashamed of what he had done and had undergone extreme rehabilitation in 2019.

This case had been hanging over his client’s head for 11 years, he added.

Judge John Aylmer said there was a relatively low volume of images compared to other similar cases and he placed it in the mid range of such offences.

Before mitigation he said it merited a sentence of two years in prison.

The court was told that Jastrezebski posed a low risk of reoffending and that he was currently on the sex offenders register.

Judge Aylmer said he was reducing the sentence to 18 months on mitigation but would suspend the sentence if the accused entered a bond to keep the peace for two years.
