Man appears at Letterkenny court charged with strangling his daughter

A Donegal man has been charged with recklessly strangling his daughter in an incident at the family home.

The man, who is in his 50s, was before Letterkenny District Court in connection with the alleged incident from last October.

Sergeant Jim Collins told the court that the man was removed from the house. When this occurred, he was alleged to have grabbed his daughter with both hands to the throat.

Sergeant Collins said the man applied pressures impeding her breathing before lifting her off the ground and continued to apply pressure.

The court heard that during the course of the man being removed from the house, there was an interaction with his daughter, who is the injured party in the case.

The man is charged that he did without lawful excuse, intentionally or recklessly strangle or suffocate another person. He is further charged with assault causing harm.

The charges are both contrary to the Non-Fatal Non-Fatal Offences Against the Person Act.

A standalone offence for non-fatal strangulation came into effect in 2023 and was included in the Criminal Justice (Miscellaneous Provisions) Act 2023.

Judge Éiteáin Cunningham accepted jurisdiction in the case and the accused man was represented by solicitor Mr Frank Dorrian.

The case was adjourned until September when the accused will have to either plead guilty or seek a hearing date.
