Schoolgirl awarded almost €28,000 after being showered with glass in crash

An 8 year old schoolgirl who was showered with glass during a car crash has been awarded €27,860.

The girl, who was at the time of the accident on July 6th, 2013, was wearing a seatbelt at the time.

However, Letterkenny Circuit Court heard how the rear window of the car smashed and came in on top of her causing her a number of small abrasions.

The girl recovered and suffered no severe physical injuries but began to suffer psychological symptoms.

Judge John O’Hagan was told the girl, who appeared in court with her parents, suffered night terrors and became aggressive when playing with her toys and also didn’t like being away from her mother.

She was also very anxious when travelling as a passenger.

Judge O’Hagan said he had read the reports into the girls injuries and remarked that she has had a “rough time” over the past couple of years.

He said he had no hesitation in recommending the sum offered in the case.

He allowed special damages of €360 to be paid to her legal team and another €250 to be paid out to the girl for her parents to buy her a small token for all she has been through.

He then ordered the balance of the money to be lodged with the accountant at the Four Courts until she reaches the age of 18.
