Man attacked takeaway with eight foot plank after being refused access to toilet

A man who attacked a fast-food takeaway with an eight-foot-long plank of wood when he was refused entry to toilets has been jailed.

Dean Kelly, 21, appeared at Letterkenny District Court in Co Donegal charged with criminal damage.

Kelly entered the Tasty Bites Takeaway on April 19th, 2016 and was intoxicated.

He ordered food but began fidgeting with a light fitting and was asked to stop before being told that the toilets were not working.

He kicked in the door of the toilet before being refunding his money and asked to leave the premises.

However, he returned with an eight-foot-long plank of wood and began attacking the premises.

He then lifted up a cash register and smashed it on the ground causing overall damage of more than €800.

He injured his eye during the incident and was later found by Gardai waiting at a bus-stop and taken to Letterkenny garda station.

Solicitor Patsy Gallagher said his client had an issue with alcohol but had turned his life around.

He had been in Castlerea Prison on robbery offences but had been transferred to Loughlin House because he had shown a willingness to be rehabilitated.

“He is a different man today,” said Mr Gallagher.

Judge Paul Kelly asked if Kelly could pay any compensation to the business but his solicitor said he was not in a position to do so at present.

Judge Kelly then sentenced the accused to three months in prison to run concurrently with his other sentence.
