Man swerving across white line was three times over limit

March 8, 2023

A man has been banned from driving for three years after being caught over three times the legal drink-
drive limit.

Gardai were on mobile patrol on September 11, 2022 at 4.10am on Letterkenny Road, Ballybofey, when
they observed a grey Volkswagen Passat swerving over a continuous white line on the road.

Sergeant Sean McDaid told Letterkenny District Court that Gardai stopped the vehicle, which was being
driven by Shane McGilloway.

Officers formed the opinion that McGilloway, a 28-year-old of Barry Street, Derry, was driving under the
influence of alcohol.

Following his arrest, McGilloway was brought to Letterkenny Garda Station, where a breath test showed
75 microgrammes of alcohol per 100 millilitres of breath.

Mr Frank Dorrian, solicitor for McGilloway, said his client, a father-of-two who is a factory worker in
Derry, was ‘particularly cooperative and apologetic’.

The court heard that McGilloway had two previous convictions, for dangerous driving and a hit and run.
Judge Éiteáin Cunningham convicted McGilloway and disqualified him from driving for three years.

McGilloway was also fined €200.
