May 13, 2023

A man has pleaded guilty to assaulting another man with an iron bar before taking his car.

John McGinley (19) was brought before Letterkenny Circuit Court on seven charges relating to incidents on four different dates between 2019 and 2022.

McGinley, of Glenard Park, Letterkenny, was brought to court from Castlerea Prison where he is serving a sentence.

He is charged with the unlawful seizure of a vehicle on March 13, 2022 at Ard Lonan, Long Lane, Letterkenny. It is alleged he unlawfully seized a Toyota Yaris by force, by assaulting a man with an iron bar and demanding the keys from another man.

McGinley is charged with assault causing harm to a man on the same date at the same location.

He is also charged with criminal damage to three windows at Glenard Park, Long Lane, Letterkenny on March 13, 2022.

He is charged with a theft on August 21, 2021 at Hazelbrook Crescent, Long Lane, Letterkenny. Then, he is charged with dishonestly appropriating property, car keys and house keys.

McGinley is charged with criminal damage to a window at a property at the same address on the same date.

The accused faces a charge of criminal damage to a Scania lorry on November 1, 2019 at a construction site at Long Lane, Letterkenny.

He has further been charged with assaulting a man and causing him harm on June 26, 2021 at Glenard Park, Long Lane, Letterkenny. McGinley spoke only to plead guilty to the charges.

Barrister for the State, Ms Patricia McLaughlin BL, told the court that there was also a dangerous driving summons to be added to the indictment and a guilty plea was indicated.

Colm Smyth SC, barrister for McGinley, said a probation report previously prepared on behalf of McGinley had to be updated. Mr Smyth was added to McGinley’s defence team on Friday with the accused also represented by Mr Peter Nolan BL, instructed by solicitor Mr Rory O’Brien.

Judge John Aylmer requested a probation to include McGinley’s suitability for community service.

The case was adjourned to June with McGinley remanded in custody.
