Letterkenny man to stand trial for fraud and theft offences

A Letterkenny man is to stand trial next year on a series of theft and fraud offences.

Sean Gallagher faces eight separate charges and will go before Letterkenny Circuit Court in 2024.

A book of evidence was this week served on Gallagher, a 45-year-old of Burnside Park, Letterkenny.

At Monday’s sitting of Letterkenny District Court, Garda Pauline Doherty gave evidence of serving a book of evidence on Gallagher.

Gallagher is charged with possessing stolen property – a Parkside sander valued at €19.99 and two Parkside cordless screwdrivers, each valued at €19.99 – at Main Street, Manorcunningham on May 5, 2020, knowing that the property was stolen or was reckless as to whether it was stolen.

Gallagher is also charged that he did, on various dates between May 20, 2011 and May 5, 2020, both dates inclusive, did engage in converting, transferring, handling, acquiring, possession or using the said property that is proceeds of criminal conduct, to wit money credited to a Paypal account in his own name.

He is charged with another count that on various dates between May 24, 2016 and May 5, 2020, both dates inclusive, did engage in converting, transferring, handling, acquiring, possession or using the said property that is proceeds of criminal conduct, to wit money credited to an AIB account in his own name.

Gallagher faces a similar charge relating to a Coinbase account on dates between 2016 and 2020 and two further charges that relate to a Coinbase account in the name of another person between 2017 and 2020.

He is also charged that on May 5, 2020, at Burnside Park, Letterkenny, he did possess stolen property to wit a large quantity of ALDI and LIDL products to the value of €7,953.58 knowing that the property was stolen or was reckless as to whether it was stolen.

Gallagher is also charged with stealing goods valued at €39.78 from Aldi, Ramelton Road, Letterkenny, on September 11, 2020. The items include Boyles gin valued at €24.58, a pack of Gorilla glue worth €4.41, one pack of mugs valued at €4.90 and a glass canister worth €5.89.

Sergeant Jim Collins told the court that the Director of Public Prosecutions (DPP) has consented for the accused to be forwarded to the next sitting of Letterkenny Circuit Court, which commences on January 23, 2024.

Judge Éiteáin Cunningham made an order returning Gallagher for trial and administered the alibi warning. A section 56 order, relating to tapes of interviews, was made.

Legal aid was granted to solicitor Mr Patsy Gallagher and two legal counsel were assigned with the solicitor remarking that it is a ‘fairly substantial book’.

The defendant was remanded on continuing bail on the same terms and conditions.
